| 摘 要： | 在产品质量法中,行政执法根据的确定性问题一直是困扰行政执法的关键问题之一。本文试图从行政法律体系的完善和行政法本身的确定性问题入手,通过梳理行政执法根据确定性不足的历史成因来分析政府在产品质量法的行政执法中的责任问题,由此对产品质量法立法中存在的问题进行了详细的论述,并提出相应对策,以期对我国产品质量法的完善尤其是行政执法根据的确定性问题有所助益。
