| 摘 要： | <海商法>修改不仅应当重视宏观性问题,而且还应当重视逻辑和法理这样的微观性问题.有鉴于中国文化重形而上轻形而下、重定性轻定量、重气轻形的厚重传统,逻辑和法理问题更应当得到强调.作为<海商法>修改应采的一种微观方法,逻辑和法理可以通过对具体法条的考察而得到实证.

| Abstract: | The Amendment of Maritime Law should attach importance to not only macrocosm issues but also microcosm issues like logic and jurisprudence.In view of the Chinese traditional culture which emphasizes quality,spirit and Abstract thing more than quantity,shape and concrete thing,logic and jurisprudence should be given more emphasis.As a method applied in Maritime Law amendment,logic and jurisprudence can be proved practically. |
