| 摘 要： | 当事人间竞价执行模式是针对传统民事执行模式不足而提出的。从民事强制执行的当事人主义——职权主义这一对立性视角出发,在理论和实践两个层面展开研究:理论层面,从制度生成的内外在要求两方面论证了当事人间竞价执行模式生成,并围绕程序正义、诉讼效率、司法权威三个方面分析了当事人间竞价执行模式价值;实践层面,从利益平衡和法条兼容的角度分析了该模式的可行性,并进而从适用范围、操作程序和法律构成要件等方面具体给出了当事人间竞价执行程序的实现路径。
