《内罗毕国际船舶残骸清除公约》的国内化对策研究

《内罗毕残骸清除国际公约》(以下简称《公约》)的生效实施将在世界范围内确定残骸清除的统一规则和程序,为缔约国清除公约水域内的船舶残骸提供法律基础。本文通过深入分析《公约》国内化面临的主要问题,提出了我国立法机关和海事管理部门为履行公约应采取的对策。

Nairobi International Convention on the Removal of Wrecks Domestic Countermeasures Study

Nairobi international convention on the removal of wrecks(Hereinafter is referred to the Convention) has come into effect,established a unity of wrecks removal rules and procedures in the world scope and provided the contracting states a legal basis for them to remove the wrecks in the Convention waters.On the basis of profound analysis of the problem of localizing the convention,this paper illustrates the necessary measures to implement the convention by the legislature and the maritime administration.
