| 摘 要： | 本文重点探讨了金融全球化背景下金融国际调节的必要性、可能性（经济合理性）以及是否具有正义性（公平性）的问题。不仅对金融全球化与金融国际调节必要性之间的内在联系进行了逻辑分析，还运用经济分析法学的观点和方法深入说明了金融国际调节何以可能，运用价值分析方法论述了当令金融国际调节的正义性悖论——形式正义与实质非正义。为我国积极应对金融全球化趋势下的金融国际调节提供了理论基础。

| Abstract: | This essay emphasizes the necessity,possibility(economic rationality) and justifiability(impartiality) of international regulation of finance in the background of financial globalization.The author not only logically analyzes the internal connection between financial globalization and the necessity of international financial regulation,but also elucidates the possibility of international financial regulation following an economic approach. In addition,the author discusses formal justice and substantial non-justice using value analysis.This research provides theoretical basis for China's active regulation in the process of financial globalization. |
