摘    要:该文首先对国内外最低价中标的发展概况进行了阐述,说明了最低价中标在工程项目中的优势。接着,分析了政府投资项目中最低价中标法中存在几个的问题:第一,恶意低价竞标,使中标价低于成本价;第二,低价中标后更改原设计,重新报价,增加投资;第三,低价中标后对工程进行层层分包,不顾法律,扰乱规则,严重影响工程顺利实施。对此,该文一一提出解决上述问题的建议,以完善政府投资项目最低价中标法,推广最低价中标法在工程中的应用,使政府投资项目既可以最大限度地减少投入,又可以保证项目质量、进度、安全等方面的顺利实施,从而为投资方创造最大价值。

Abstract:The article firstly sets forth the development situations of winning bid by the minimum price at home and abroad,explains the superiority of winning bid by the minimum price in the engineering projects,and then analyzes some problems existing in the winning bid by the minimum price in the government’s invested projects:1.Low price competition for bids by malice makes the price of winning bid is lower than the cost price;2.The low price after winning bid changes the original design,renews the quoted price,and adds the investment;3.The low price after winning bid causes the subcontracts one upon one,neglects the law and disturbs the rule seriously to influence the smooth implementation of the projects.Therefore,the article puts forward the suggestions for solving the above problems to perfect the bid winning method by the minimum price of the government’s invested project,to spread the application of the bid winning method by the minimum price in the projects,to make the government’s invested projects not only furthest decrease the investment,but also able to guarantee the smooth implementation of the project quality,schedule and safety so as to create the maximum value for the investors.
