梁启超与中国法制的现代化

本文从法治思想、宪政理想与立宪活动以肪司法改革实践三个层面阐述梁启超对中国近代法制的作用与影响，认为梁启超宣传以西方民权学说和民主原则为基础的法治思想与宪政主张是中国近代法制启蒙的重要组成部分，他对宪政的设计和推动促进了晚清的政治和法制改革，是促成和推进辛亥革命浪潮发生、发展的重要力量，他改革司法制度、倡导司法独立的主张和实践对于中国法律思想和法制的现代化都具有非常重要的现实意义。

Liang Qi-chao and the Modernization of China's Legal System

This paper elaborates the impact of Liang Qi chao on China's modern legal system from three aspects: law ideology, constitutionalism ideology and judicial reform. Liang Qi chao's law ideology and constitutionalism proposition is a key component of the enlightenment of China's modern legal system. His design and promotion of constitutionalism accelerated the reform of late Qing Dynasty, which was the driving force of the occurrence and development of Xinhai Revolution. His practice on judicial reform and judicial independence has significant influence.
