浅析海事行政强制中的“代履行”

目前，我国仍没有行政强制方面专门的法律规范，对行政强制的系统研究对指导工作实践具有重要意义。本文主要从海事管理机构的角度分析了行政强制执行常见的一种方式一“代履行”的定义、要件以及应遵循的原则，并提出了海事管理实践中应用“代履行”应注意的问题。

At present, there are no specific regulations on the administrative compulsory enforcement. The study on the administrative compulsory enforcement is of great significance for providing guidance to the present work. This article analyzes the ＂acting-perform＂, one of the popular form in our daily administrative enforcement, its definition, its key elements and the principles it should follow, and probes the problems relating the ＂acting-perform＂ in the maritime administrative practice.
