场域理论与马克思主义法学理论的发展——以法官审判行为为例的场域分析

布迪厄的场域理论是对我国马克思主义法学理论的必要补充。场域理论可以作为研究我国现阶段法官审判行为的分析工具。现阶段我国法官处于"法律场域"、"权力机构场域"、"传统文化场域"、"社会生活场域"等多重场域中,而"多重场域彼此影响",这种影响是通过场域中个体的实践活动实现的,当多重场域的影响与法官的审判行为发生冲突时,法官的审判行为就具有了选择的可能,这种经过选择的审判结果往往是偏离法律规范的,而隐藏在背后主导法官审判选择行为发生的深层次原因就是惯习。

Field Theory and the Development of Marxist Jurisprudence——Field Analysis of the Judge's Trial Behavior

Bourdiu's field theory is an essential supplement to China's Marxist jurisprudence, and it can be used to study the judge's trial behavior of our country at present.The judges in China play roles in multiple fields,such as"the field of law","the field of power organs","the field of traditional culture","the field of social life".These multiple fields interact with each other.Such interactions are caused by the individual practice in the fields.When the interaction is in conflict with the judge's trial behavior,the judge will then have to make a choice,and the result of the trial after the choice often deviates from the legal norm.The underlying reason for the deviation is nothing but habitus.
