| 摘 要： | 学术界对是否保护“死名誉”大致有3种取向，就其中占主流地位的“肯定说”，又有6种学说阐述其理论基础，然而这6种理论皆有其不足之外，在借鉴已有理论合理内涵的基础上，本提出了“权利延伸保护说”。

| Abstract: | In the academe, there are 3 kinds of attitudes towards whether to protect the reputation of decedents or not, and among them, the attitude of affirmation is dominant. There are 6 kinds of theories supporting this attitude, but every one of them has some deficiencies. Based on the rational connotations of the previous theories, the paper puts forward the theory of protecting extended right. |
