| 摘 要： | 《侵权责任法》第一次把医疗及其损害赔偿责任设立专章进行了规范,把复杂的医患关系置于法律的框架之下。但是侵权责任法实施后,法院如何适用该法审理医疗损害纠纷案件面临一些问题。本文就《侵权责任法》和《医疗事故处理条例》短期内并行条件下如何适用以及举证责任分配、现行医疗鉴定体制及医疗机构免责事由对《侵权责任法》适用的影响进行分析,并就这些问题探讨解决的方法和途径。
