The identification of the responsible shipowner is essential for seafarers in order to claim payments and compensation in respect of their employment on board a ship. Often this may be difficult because of corporate arrangements and the many intermediaries traditionally involved in ship operation. The Maritime Labour Convention 2006 (MLC, 2006), adopted by the International Labour Conference (ILC) 94th (Maritime) Session in 2006, entered into force on August 2013; it significantly affects the shipowner’s responsibility in respect to seafarers’ employment. Taking into account the mentioned issue, the article examines the concept of “shipowner” under the MLC, 2006 and presents comparative analysis of the relevant national law implementing the MLC, 2006 in Denmark, Finland, Germany, Norway, and the United Kingdom. 相似文献

The research is aimed to identify factors in the maritime education and training (MET) system and its relationship on maritime labour employers’ (MLEs) trust based on current practice in Malaysia. A questionnaire survey was used, and the respondents were the participants of a related conference in Malaysia. The structural equation modelling technique was used to explain the relationships in the stipulated research model. The test of structural model confirms that the model is adequate in explaining the MLEs’ trust. The results reveal that the perceived MET institutions’ efficiency has significant direct effects on the MLEs’ trust and the perceived seafarers’ competency. In addition, the perceived implementation of International Convention was found to significantly affect the seafarers’ competency. However, the perceived seafarers’ competency was not found to directly affect the MLEs’ trust. This study suggests that the MLEs’ trust is an important indicator and feedback on it can be used to further enhance the current MET system and its policies. Thus, one of the strategies is to develop a policy in order to achieve an effective maritime education and training. This is to support the maritime communities in progressing towards a more sustainable development in the MET in the context of enhancing the maritime safety. 相似文献

In accordance with Part A, Chapter I, Section I/11 Revalidation of Certificates of the Standards of Training, Certification and Watchkeeping for Seafarers (STCW) 2010 Convention, continued evaluation of professional competence shall be established, among others, by successfully completing an approved training course or courses. Every master, officer and radio operator holding a certificate issued or recognised under any chapter of the convention other than chapter VI, who is serving at sea or intends to return to sea after a period ashore, shall be required, at intervals not exceeding 5 years, to demonstrate continued professional competence, in order to continue to qualify for seagoing service. The main objective of this research is to design a model course using simulation technology to train and demonstrate seafarers’ competence in accordance with the provisions of STCW Code for existing seafarers who need to revalidate their professional maritime certificates also in accordance with the standards governing the use of simulators, Reg I/12 of 2010 STCW Code. The purpose of this revalidation simulation-based model course is to assist maritime training institutes and their teaching staff in organising and introducing specific training courses for revalidation of certificates of competence (CoCs) as well as enhancing, updating or supplementing existing training material where the quality and effectiveness of the training courses may thereby be improved.
